Assuming the officer is competent and Kaepernick wasn't being a deadly suspect, Kaepernick would be fine.

Wishing harm on people is weak, especially when their "criminal record" includes not standing for the national anthem (or something like that) and wearing socks with pigs dressed as police officers. Maybe Kaepernick is a terrible person, but based on what I've heard, being a shitty quarterback with a bad opinion of law enforcement is hardly worth wishing them harm.
